1. Acceptance of Terms

By accessing or using PromptRail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

PromptRail is an AI Governance platform that helps organizations monitor, audit, and secure AI usage across their workforce. The Service includes:

  • • Browser Extension: Captures AI interactions across platforms like ChatGPT, Claude, Gemini, and others
  • • PII Detection: Automatically scans prompts for sensitive personal information
  • • Audit Trail: Complete logging of all AI interactions for compliance
  • • Team Management: Organizational analytics by team and department
  • • Compliance Reports: Exportable reports for SOC2, HIPAA, and GDPR audits

3. Data Collection and Processing

What We Capture: When the browser extension is active, PromptRail captures prompts sent to AI platforms and responses received. This data is stored securely and accessible only to authorized users within your organization.

PII Detection: Our system automatically scans captured content for personal identifiable information (PII) including emails, phone numbers, social security numbers, credit card numbers, and API keys. Detection results are flagged for review.

Retention: Audit logs are retained according to your organization's configured retention policy, with options for 30, 90, 180, or 365 days.

4. User Accounts and Access

You are responsible for maintaining the security of your account credentials. Organization administrators are responsible for managing user access and permissions. You must notify us immediately of any unauthorized access to your account.

5. Free and Paid Tiers

Free Tier: PromptRail offers a free tier for teams up to 5 users with core governance features including basic capture, PII detection, and 30-day audit retention.

Paid Tiers: Professional and Enterprise tiers include advanced features such as unlimited users, extended retention, compliance reports, SIEM integration, and priority support. Pricing is per user per month for Professional tier, and custom pricing for Enterprise.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • • Use the Service in violation of any applicable laws or regulations
  • • Attempt to circumvent or disable any security features of the Service
  • • Use the Service to monitor employees without appropriate disclosure and consent as required by applicable law
  • • Share access credentials or allow unauthorized access to the Service

7. Employee Monitoring Disclosure

IMPORTANT: If you use PromptRail to monitor employee AI usage, you are solely responsible for providing appropriate notice to employees and obtaining any required consent under applicable employment and privacy laws. PromptRail is designed as a governance tool to help organizations maintain compliance and security, not as covert surveillance software.

8. Intellectual Property

Your Data: You retain all rights to the data captured and stored through the Service.

Our Platform: PromptRail and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Third-Party AI Platforms

PromptRail captures interactions with third-party AI platforms. We do not control these platforms and are not responsible for their actions, policies, or availability. Your use of those platforms is subject to their respective terms of service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTRAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless PromptRail from any claims, damages, or expenses arising from your use of the Service, including but not limited to claims related to employee monitoring and privacy violations resulting from your failure to provide required notices or obtain required consent.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
